TRILL Matching — Terms of Use

These Terms of Use ("Terms") are an agreement between you and Trill Matching Inc ("TRILL," "we," "us"). They govern the TRILL mobile app, trillmatching.com, and related online matching features (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy explains how we handle personal information. Additional purchase terms shown at checkout apply to that purchase; where they conflict with these Terms about price or billing, the checkout terms control for that purchase.

Important: Section 15 contains an agreement to individual arbitration and a class action waiver, subject to stated exceptions and applicable law. You may opt out within 30 days as described in Section 15.

1. Who may use TRILL

• You must be at least 18, able to enter a binding contract, and permitted by law to use the Service.

• You must use your own account, provide accurate information (including your age and relationship intentions), keep it reasonably current, and protect your login credentials.

• You may not create another account after a suspension or ban without our permission.

• We may decline registration or restrict an account when reasonably necessary to protect members or the Service.

• TRILL is for individual, personal use. Commercial solicitation is prohibited.

2. How matching works

TRILL uses each person's stated preferences, profile information, assessments, and settings to present potential mutual fits. A mutual fit means that available criteria appear to align in both directions at the time shown. It does not mean that TRILL has verified every answer, that every preference is guaranteed, or that two people are compatible or will meet. Scores, rankings, suggested matches, and assessment results are informational, may change, and are not professional psychological assessments.

The Service may offer different discovery flows based on members' settings and the people they seek. In the current heterosexual flow, a woman's profile is intended to stay hidden from men until she sends a like, and men ordinarily see women who have liked them. Visibility controls limit in-app discovery; they do not make a profile impossible to capture, disclose, or access through another member's actions or a security incident. The options shown in the app govern your experience. We may adjust features, eligibility, and matching methods, with notice where required by law. TRILL does not guarantee any number of profiles, likes, matches, conversations, dates, or relationships.

3. Safety, screening, and member conduct

Do not assume a profile is safe because it appears on TRILL, is marked verified, or has passed a review. All members must complete photo verification, which confirms that a member's profile photos match a selfie taken in the App. Photo verification does not confirm legal identity, criminal history, intentions, or safety, and TRILL does not run criminal background checks. Take care online and when meeting in person. If there is immediate danger, contact local emergency services.

You may not:

• misrepresent your identity or age, or impersonate anyone;

• use bots, fake profiles, scraping, or unauthorized automated tools;

• solicit money, financial information, or sexual services;

• send spam or commercial offers;

• harass, stalk, threaten, discriminate against, or exploit others;

• share someone else's personal information without permission;

• upload unlawful, sexually explicit, sexually exploitative, hateful, violent, infringing, or malicious content;

• evade a suspension or ban, or compromise the Service;

• use information about members for anything other than personal matching.

Sexual content involving minors is strictly forbidden and will be reported to the authorities. Respect others' consent and boundaries on and off the Service.

Zero tolerance for objectionable content and abusive users

• TRILL has zero tolerance for objectionable content and abusive users.

• Report: You can report any profile, photo, or message using the in-app Report option, or by emailing support@trillmatching.com.

• Block: You can block any member. Blocking immediately removes that member from your feed, matches, and chats, and notifies our team.

• 24-hour review: We review all reports within 24 hours. When content violates these Terms, we remove it and remove (ban) the user who posted it.

We may also remove content, limit visibility, suspend or terminate access, investigate reports, and preserve or disclose information when reasonably necessary for safety, enforcement, or legal compliance. While we act on every report, we cannot monitor all content or communications in real time.

4. Your content and other members' content

You keep ownership of the photos, text, voice intros, messages, and other material you submit ("Your Content"). You confirm that you have the rights to submit it, that it is accurate where it describes you, and that it follows these Terms. You grant TRILL a non-exclusive, worldwide, royalty-free license to host, reproduce, adapt for technical display, and distribute Your Content to the members you choose or whose access the Service enables, only to operate, secure, moderate, and improve the Service and as described in our Privacy Policy. This license ends when Your Content is deleted, except for reasonable backups, legal retention, prior sharing, and copies others lawfully kept. We will not use your profile photo in outside advertising without your separate permission.

Other members' content belongs to them or their licensors. You may view it only through the Service for its intended purpose. You may not scrape, republish, train models on, sell, or publicly share it without permission. Members can take screenshots or otherwise disclose what they see, so TRILL cannot guarantee confidentiality once you share something with another member.

Photo verification

All members must complete photo verification by taking a selfie, which is compared with their profile photos to confirm the photos are theirs. The comparison is performed by Amazon Rekognition (Amazon Web Services) on our behalf. TRILL does not store the selfie or any face data; we keep only your verification status until your account is deleted. Full details on how face data is collected, used, shared, retained, and deleted, and how you can revoke consent, are in Section 4 ("Photo Verification and Face Data") of our Privacy Policy.

5. Privacy and communications

Our Privacy Policy describes how we collect, use, share, and retain information and your privacy choices, including sensitive information such as dating preferences and assessment answers. Do not put contact details, payment information, or another person's sensitive information in your public profile.

We may send necessary account, safety, billing, and service messages. Marketing messages and optional notifications follow your consent and opt-out choices. Any AI coaching or suggestions in the Service are automated, may be inaccurate, and are not mental-health treatment or emergency support. Do not rely on them for medical, legal, or crisis decisions.

6. Purchases, credits, and subscriptions

Offerings may include free matching for women, a charge for other members at the point of match, credits for eligible matches, optional premium subscriptions, and other features. The price, who pays, what triggers a charge, credit quantity, taxes, and any renewal terms are shown before you authorize each purchase. Promotional prices and features may vary. We will not charge you just for viewing a like unless the checkout screen clearly describes a separate purchase.

Credits. Credits are a limited, personal, non-transferable right to access specified digital features. They are not cash, a deposit, or a bank balance, and cannot be transferred or redeemed for money. Any expiry or usage limits are shown at purchase; otherwise, purchased credits do not expire while your account is active. A match charge applies only at the trigger described at checkout. We will not increase the number of credits needed for a match you have already authorized.

Subscriptions. For a renewing subscription, the price, billing period, renewal, trial conversion, and cancellation method are shown before purchase and confirmed afterward. It renews until canceled. Canceling stops future renewals; you normally keep access until the end of the paid period. Cancel through the platform that billed you (Apple App Store or Google Play subscription settings). For a direct TRILL purchase, use the cancellation controls in the App or contact support@trillmatching.com. Deleting the app or your account does not cancel a store-billed subscription.

Refunds. Apple or Google process app-store purchases and handle refunds under their own policies. For direct purchases, request a refund at support@trillmatching.com. Refunds and statutory cancellation rights apply where required by law; these Terms do not waive them. We may correct billing errors and issue credits or refunds when appropriate. A chargeback may trigger a temporary review but does not by itself establish misconduct. In-person events or coaching, if offered, have separate terms.

7. Intellectual property and app license

TRILL and its licensors own the App, design, software, trademarks, and other Service materials, other than member content. Subject to these Terms, we grant you a limited, revocable, non-transferable license to use the App for personal use. You may not reverse engineer, copy, resell, or exploit it except as allowed by law. We may use feedback you send without payment; this does not give us ownership of your personal data or Your Content.

8. Third-party services

The Service may link to app stores, payment providers, event platforms, maps, or external sites. Their own terms and privacy practices apply. TRILL does not control third-party content or purchases made directly from those providers.

9. Deleting or ending your account

• Delete in the App: Settings → Account Actions → Delete account. Deletion is permanent and cannot be undone.

• Other options: follow the steps at trillmatching.com/delete-account or email support@trillmatching.com.

• Deleting your account removes your profile, photos, matches, messages, and verification status, subject to limited retention described in the Privacy Policy (for example billing records, safety records, and records needed to keep banned users from rejoining). Content already received by other members may remain with them.

• Deleting your account does not cancel a store-billed subscription — see Section 6.

We may suspend or terminate access for violations, fraud, safety risks, legal obligations, or if we discontinue the Service. Where practical and safe, we will explain a restriction and offer a way to appeal. Sections meant to survive termination — including payment obligations already incurred, licenses needed for retained material, disclaimers, liability limits, and dispute terms — survive.

10. Disclaimers

The Service is provided "as is" and "as available" to the extent permitted by law. We do not promise uninterrupted service or guarantee another member's identity, conduct, statements, availability, compatibility, or response. TRILL is not a substitute for your own judgment or safety precautions. Nothing in these Terms excludes rights or liability that cannot legally be excluded, including liability for fraud.

11. Limits on liability

To the extent permitted by law, TRILL and its officers, employees, and service providers are not liable for indirect, incidental, special, consequential, or punitive damages arising from the Service. Our total liability for claims related to the Service will not exceed the greater of US$100 or the amount you paid TRILL for the Service in the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law and do not limit your statutory rights or remedies for unauthorized charges.

12. Your responsibility for claims

To the extent permitted by law, you will reimburse TRILL for reasonable losses and expenses from third-party claims caused by your unlawful conduct, your infringement of another person's rights, or your material breach of these Terms, except to the extent TRILL caused the claim. We will notify you and allow reasonable participation in the defense. You are not required to defend TRILL against claims arising from its own acts or omissions.

13. Changes to the Service and these Terms

We may change the Service and these Terms. We will post updated Terms with a new effective date and give reasonable advance notice of material changes by email or in-app notice where feasible or required. Material changes to dispute terms apply only going forward unless you agree otherwise. If you do not agree, stop using the Service and delete your account. Continued use after the effective date means you accept the changes, except where law requires additional consent. Existing purchases remain subject to the terms shown when you bought them unless a change is lawful and properly disclosed.

14. Copyright complaints

If you believe content on TRILL infringes your copyright, send a notice to support@trillmatching.com that includes: the work; the infringing content and where it appears; your contact information; a good-faith statement; a statement, under penalty of perjury, that the notice is accurate and you are authorized to act; and your signature. We may remove the content and offer a counter-notice process under the Digital Millennium Copyright Act.

15. Disputes and arbitration

Informal resolution first. Before filing a claim, you and TRILL agree to send a written notice describing the issue and the requested resolution (TRILL's address: support@trillmatching.com) and to try to resolve it informally for 30 days. This does not stop you from seeking urgent relief or reporting to a regulator.

Arbitration. Except for eligible small-claims matters, claims for individual injunctive relief to protect intellectual property, and disputes about sexual assault or sexual harassment covered by the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act, disputes arising out of these Terms or the Service will be resolved by individual binding arbitration under the Federal Arbitration Act, administered by the American Arbitration Association under its consumer rules. The arbitrator may award the same individual remedies as a court. AAA consumer fee limits and applicable law govern fees. Either party may instead bring an eligible individual claim in small-claims court.

Class action waiver. You and TRILL waive class and representative proceedings and jury trials to the extent permitted by law. If a claim cannot lawfully be arbitrated, or this waiver is unenforceable for that claim, it will proceed in court after arbitrable claims are resolved, unless law requires otherwise. Nothing here prevents a request for public injunctive relief where the law protects that right.

Opt-out. You may opt out of this arbitration agreement by emailing support@trillmatching.com within 30 days of first accepting these Terms, with your name, account email or phone number, and a clear statement that you opt out. Opting out does not affect the rest of these Terms; Section 16 then governs court proceedings.

16. Governing law and courts

Delaware law governs these Terms, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs arbitration and mandatory consumer law where you live still applies. For disputes heard in court, the parties consent to state or federal courts in Delaware, unless applicable law lets you sue in your home jurisdiction or requires a different forum.

17. Apple app terms

If you downloaded the App from Apple, these Terms are between you and TRILL, not Apple. Apple has no obligation to maintain or support the App and is not responsible for claims relating to it. Apple and its subsidiaries are third-party beneficiaries of the license in Section 7 and may enforce it. Apple handles any refund of the App's purchase price under its own rules. You confirm that you are not in a U.S.-embargoed country or on a U.S. prohibited-party list.
